Acceptable Use Policy

1. Purpose and Scope
This Acceptable Use Policy (AUP) sets out the rules governing use of DataPasa Limited's cloud hosting services (Services). It applies to all customers and any users they authorise to access the Services.
This AUP is incorporated into and forms part of our Terms of Service. Breach of this AUP is a breach of the Terms of Service and may result in suspension or termination of your account.
2. Prohibited Content
You must not store, transmit, or distribute content that:
- Constitutes or facilitates child sexual abuse material (CSAM) — this is a criminal offence under the Protection of Children Act 1978 and will be reported to the National Crime Agency and relevant authorities immediately.
- Is illegal under the laws of England and Wales or the jurisdiction of the end user.
- Infringes any intellectual property rights, including distributing copyrighted material without authorisation.
- Is defamatory, obscene, or constitutes harassment or incitement to hatred.
- Constitutes unsolicited commercial communication (spam) in breach of the UK Privacy and Electronic Communications Regulations 2003.
3. Prohibited Activities
You must not use the Services to:
- Network attacks — launch or facilitate Distributed Denial of Service (DDoS) attacks, port scanning, network probing, or any form of attack against third-party systems.
- Spam and bulk email — send unsolicited bulk email or operate open mail relays.
- Phishing and fraud — host phishing pages, fraudulent websites, or tools designed to deceive users.
- Botnet hosting — operate command-and-control servers, botnets, or malware distribution infrastructure.
- Cryptocurrency mining — operate cryptocurrency mining operations without prior written approval from DataPasa.
- VPN, proxy, and anonymisation services — operate VPN servers, proxy services, anonymisation networks, or any traffic-tunnelling or relay service, whether for personal use or resale, without prior written approval from DataPasa.
- IP spoofing — falsify source IP addresses or engage in traffic amplification attacks.
- Scraping in violation of terms — scrape third-party websites or services in violation of their terms of service.
- Illegal access — gain unauthorised access to any system, network, or data.
4. Resource Use
You must not use server resources in a way that materially degrades the performance of shared infrastructure or other customers' services. Sustained usage significantly in excess of your plan's stated specifications may result in throttling, additional charges, or suspension. If your use case requires consistently high resource levels, please contact us to discuss a suitable plan.
Where a server generates significant network load that affects shared uplinks or other customers, we reserve the right to limit the network speed of that server. Where possible, we will notify the account holder; in cases where delay would cause further degradation, throttling may be applied immediately and the account holder will be notified afterwards.
5. Reporting Abuse
To report abuse originating from DataPasa infrastructure, please email abuse@datapasa.com with full details including relevant IP addresses, timestamps, and a description of the issue. We aim to acknowledge reports within one business day.
6. Enforcement
Upon identifying a breach of this AUP, we may take any of the following actions depending on the severity and nature of the breach:
- Warning — notification to the account holder to cease the activity.
- Throttling — temporary restriction of network bandwidth or resources.
- Suspension — temporary suspension of services pending investigation or resolution.
- Termination — permanent termination of the account without refund of unused balance where the breach is serious or repeated.
- Reporting to authorities — referral of illegal activities to law enforcement agencies.
We reserve the right to take immediate action without prior notice where delay could cause harm to others or compromise network integrity.
7. Customer Responsibility
You are solely responsible for all content hosted on and all activities conducted through your servers. DataPasa acts solely as a neutral conduit and hosting provider and is not liable for any content you store or transmit. You agree to indemnify DataPasa against any claims, losses, or liabilities arising from your breach of this AUP.
8. Changes to This Policy
We may update this AUP at any time. Material changes will be notified by email. Continued use of the Services after the effective date of the updated AUP constitutes acceptance.
